File FIR against MLAs: EC tells Jharkhand govt
New Delhi: Taking note of the IBN Network-Cobrapost stories on Jharkhand MLAs selling their votes during Rajya Sabha elections, the Election Commission on Tuesday directed the Jharkhand government to lodge an FIR against MLAs caught on camera.
The three-member Election Commission on Tuesday discussed the news report and directed the Government of Jharkhand to lodge FIR under relevant provisions of law in the matter.
"What the channel has shown is few MLAs of Jharkhand Assembly as saying that on payment they can get their and their colleague first and second preference votes in the matter. This amounts to offence of bribery at an election under section 171 of IPC," said the Election Commission. The Election Commission also said that the sale of votes also amounted to offence under Section 8 and 9 of Prevention of Corruption Act.
Chief Election Commissioner SY Quraishi had expressed his shock and outrage soon after the sting was aired on Monday showing MLAs belonging to the Congress, Jharkhand Mukti Morch and Bharatiya Janata Party demanding money to vote on favour of a candidate during Rajya Sabha elections. The MLAs were also seen boasting that they could get more MLAs to vote if they were paid.
Four Congress MLAs, one BJP and two JMM MLAs were caught on camera demanding money to vote for a particular candidate during Rajya Sabha elections. So far the political parties have not initiated any action against the MLAs.
