Law catches up with Amit Shah, arrest imminent
Ahmedabad: A day after CNN-IBN reported exclusive details of evidence collected by the CBI against Gujarat Minister of State for Home Amit Shah in the Sohrabuddin Shaikh fake encounter case, theinvestigating agency on Friday formally filed charges against him.
But Narendra Modi's right hand man, now accused of conspiracy in the case, remains missing, despite two summons by the CBI. The CBI even raided Shah's residence and his anticipatory bail plea has been rejected by special CBI court judge GK Upadhaya.
So the law is catching with the man in charge of upholding the rule of law in Gujarat and Shah's arrest is now imminent. There was an air of anticipation outside the CBI office in Gandhinagar- as the investigating agency waited for Shah turn up for questioning in the Sohrabuddin fake encounter case. But at 11 AM instead of Shah it was his lawyer Mitesh Amin who reached the CBI office, seeking more time for Shah to appear before theinvestigating agency. Amin also requested for a list of questions that are likely to be put to Shah in connection with the fake encounter case. The CBI declined both requests.
"I asked for the questionnaire but CBI refused saying it's not necessary. We will now explore legal options like anticipatory bail," said Amin after meet CBI officials.
As the 1 PM deadline for Shah ran out, the CBI began its search. At 2 PM on Friday, CBI officers reached shah's Gandhinagar office and questioned his personal secretary.
By 3 PM fearing arrest Gujarat Chief Minister Narendra Modi's trusted lieutenant moved the court filing for anticipatory bail. But just an hour later at 4 PM CBI checkmated Shah's efforts to evade arrest and filed a chargesheet against him in the CBI court, booking him for conspiracy to abduct, murder and destruction of evidence and disappearance.
Finally at 5:30 PM the court rejected his anticipatory bail clearing the deck for Shah's arrest.
What is the Sohrabuddin Shaikh encounter case?
Sohrabuddin Sheikh was killed in an alleged encounter on November 26, 2005. Three days later his wife, Kausar Bi, was also killed. The Gujarat police had then claimed Sohrabuddin belonged to the terror outfit Lashkar-e-Toiba and was planning to assassinate chief minister Narendra Modi to avenge 2002 riots. Three days later his wife Kausar Bi was killed and her body burnt, allegedly by policemen who wanted to cover-up the fake encounter.
Who was Sohrabuddin?
Sohrabuddin Sheikh had a controversial background and had been accused of being an extortionist and a petty criminal operating in Gujarat. He was also said to be running an extortion racket on behalf of the thenAhmedabad DCP (Crime) Abhay Chudasama. The officer was subsequently arrested on these charges.
Who is Tulsi Prajapati?
Tulsi Prajapati was said to be Sohrabuddin's friend and the only witness in the Sohrabuddin killing. Tulsi, a small time criminal, was lodged in the Udaipur jail and was being taken back from a court appearance in Gujarat in 2006, when the police claimed he tried to escape from custody and was killed.
How many people have been arrested so far?
A total of 15 police officials have been arrested Sohrabuddin encounter. They include 4 IPS officers - DG Vanzara, Dinesh MN, Raj Kumar Pandian and Abhay Chudasama. Two police officers have been arrested for the killing of Tulsi Prajapati as well.
Persons chargesheeted: DG Vanzara (DIG of Gujarat Police), Rajkumar Pandian (Superintendent of Police), MN Dinesh (Superintendent of Police), ML Parmar (Deputy Superintendent of Police), NH Dabhi (Police Inspector), BR Chaubey (Police Inspector), Abdul Rehman Shaikh (Police Inspector), Himanshu Singh Rajavat (Police Sub-Inspector), Shyam Singh Charan (Police Sub-Inspector) Dr NK Amin (Deputy Superintendent of Police), NV Chauhan (Police Sub-Inspector), Shri Abhay Chudasma (DCP, AhmedabadCrime, already arrested and added by CBI), Amit Shah (Minister of State for Home, Gujarat, already added during investigation by CBI but not yet arrested), Ajay Patel (ADC Bank Chairman, added duringinvestigation by CBI but not arrested), Yashpal Chudasma (ADC Bank Director, added during investigationby CBI but not yet arrested).
The CBI has not found adequate evidence against three accused who were earlier sent for trial. They are Ajay Parmar (ATS Police Constable, Ahmedabad) Sant Ram Sharma (ATS Police Constable, Ahmedabad) and BA Rathore (ATS Inspector Ahmedabad) The CBI, therefore, did not include them in its chargesheet. The Minister of State for Home was issued summons for his appearance before the CBI on July 22 and 23. He did not appear and hence chargesheet was filed without his examination.
