Fali Nariman regrets defending Union Carbide
Senior advocate Fali S Nariman, who had defended Union Carbide in 1985, has told CNN-IBN that he regrets having taken up the case. He also feels that filing of a curative petition against the 1996 judgementof former Chief Justice of India Justice AH Ahmadi as recommended by the Group of Ministers on Monday in its report of the Bhopal gas leak tragedy makes little sense as the accused cannot be tried again.
CNN-IBN: The group of ministers set up to look into the Bhopal gas issue has recommended that the 1996 judgement should be revisited. Do you think it is the right decision?
Fali S Nariman: I think it is all academic to my mind because the same set of people cannot be tried, convicted and sentenced again for a different offence and because of Section 300 of the CriminalProcedure Code.
CNN-IBN: Warren Anderson extradited?
Fali S Nariman: I know nothing about him. Let him get extradited. I don't care. Let him be extradited if that is the wish of the Government.
CNN-IBN: Is it possible?
Fali S Nariman: I don't know if it is possible. That is a political decision. That is not a leagl decision whether he should be extradited or not. It is a political decision between two states. They have to decide whether to extradite him or not. United States has to decide whether to send him here or not.
CNN-IBN: Sir there have been questions raised when you appeared for Union Carbide way back in 1985.
Fali S Nariman: That is there in my autobiography. Go and read it.
CNN-IBN: Do you have any regrets or if you were given a chance a appear for Union Carbide once again would you appear?
Fali S Nariman: No. If the same circumstances prevail (then) no.
CNN-IBN: Are you suggesting you have become a little wiser?
Fali S Nariman: Yes, yes. As you grow older you do become a little wiser.
